Scope Of Privacy Policy

collected by Itemize through other means. When you navigate away from our website

point our Privacy Policy no longer applies. Itemize does not provide a notice warning

The Information Itemize Collects
Itemize collects the following personally identifiable information ("PII") from
you: unique identifiers such as name, address, electronic user name, and email address.
Itemize may collect other additional non-PII from you, such as demographic information,
includingpostal code, gender, and education, as well as other information about
your preferences, attitudes, and behaviors.
The receipt data that Itemize collects is prohibited by law from including your
payment account details, such as a uniquely identifying credit card number. Therefore,
Itemize does not capture your full payment card number from the receipt. Nonetheless,
in the event that a receipt provided to you by a merchant includes any information
in violation of card industry standards and applicable laws, Itemize will attempt
to suppress the ingestion of such data into the Itemize system. Itemize cannot guarantee
that these attempts will be successful. If you observe full credit or debit card
account numbers on a receipt in your account, you can delete the receipt or contact
info@itemize.com. and the information will be removed from your account
and the system. If you observe other PII on receipts that you wish to be removed
from the system you can delete the receipt or contact info@itemize.com.

Additionally, Itemize does not access, collect, see, or store any information about
your payment accounts from banks or payments companies. This includes information
about credit card accounts, debit card accounts, or other financial services products.
Itemize does not collect any login information from you or others about these accounts.
Itemize does not collect any statements from these accounts, or transaction records
from these accounts.
As is true of most web sites, Itemize automatically gathers information from your
computer such as your IP address, browser type, referring/exit pages, and operating
system. You may choose to stop receiving Itemize's newsletters or marketing emails
by following the unsubscribe instructions included in these emails or you can contact

Itemize services include the collection, aggregation, analysis, and organization
of receipts and related information to provide users with useful reporting, relevant
offers, and other services that improve their organizational, purchasing, and shopping
effectiveness. By registering for an account with Itemize, you authorize Itemize
to gather, parse, and retain data and information from you that is associated with
your online and offline purchases and shopping, as is necessary to deliver and support
the Itemize services.
Itemize collects PII when you register. In registering with Itemize, you may also
provide information necessary to use Itemize, such as the login credentials for
your email or other Internet accounts that you link to Itemize.
Non-PII Collection
Whenever you visit Itemize, Itemize collects data on our server logs from your browser,
including your IP address, Itemize cookie information, and the pages you request,
and relates it to the PII you provide. Itemize uses this information to provide

From time to time, Itemize may use PII for new, unanticipated uses not previously
disclosed in our Privacy Policy. If Itemize’s information practices change, Itemize

to notify Itemize Corp. immediately of any unauthorized use of your password or

Your Use of the Service
The Service is provided for informational purposes only. You understand that all
information, data, text, NewImages, messages, and other information, that appears
in your account ("Content"), whether gathered by Itemize from receipts, partner
offers, third parties, or posted by you, are the sole responsibility of the person
or entity from whom such Content originated. Itemize Corp. does not guarantee the
accuracy, integrity, or quality of any Content. Under no circumstances will Itemize
Corp. be liable in any way for any Content, including, but not limited to, any errors
or omissions in any Content, or any loss or damage of any kind incurred as a result
of the use of Itemize.
You agree to not use the Service to: (a) access data that is not intended for your
use; (b) log on to a server or account that you are not authorized to access; (c)
probe, scan, or test the vulnerability of the system; (d) breach security or authentication
measures; (e) send promotions and/or advertising products and/or services; (f) attempt
to interfere with or disrupt the service or servers or networks connected to the

if required to do so by law or if such access, preservation, or disclosure is reasonably
necessary to: (a) comply with legal process; (b) enforce the TOS; (c) respond to
claims that any Content violates the rights of third parties; (d) respond to your
requests for customer service; or (e) protect the rights, property, or personal
safety of Itemize Corp., its users, and the public.
You authorize Itemize Corp. and the Service to access information maintained by
identified third parties (e.g., the merchants that send you email receipts and related
information), on your behalf as your agent. Solely to provide you the services of
the Service, you grant Itemize Corp. a limited power of attorney, and appoint Itemize
as your attorney-in-fact and agent, to access third-party websites, retrieve, and
use your information with the full power and authority to do and perform each thing
necessary in connection with such activities, as you could do in person. You acknowledge
and agree that when Itemize Corp. and the Service are accessing and retrieving information
from third-party websites, Itemize Corp. and the Service are acting as your agent,
and not as the agent of or on behalf of the third party.
Any unauthorized reproduction, publication, further distribution, or public exhibition
of the materials provided by the Service, in whole or in part, is strictly prohibited.
DMCA Notification
If you believe that any Content or other material provided through the Service,

Suggestions to Itemize
If you submit suggestions to Itemize Corp. or the Service through feedback or otherwise,

or proprietary information; (b) Itemize Corp. is not under any obligation of confidentiality
with respect to the suggestions; (c) Itemize Corp. shall be entitled to use or disclose
(or choose not to use or disclose) such suggestions; (d) Itemize Corp. may have
something similar to the suggestions already under consideration; (e) your suggestions
become the property of Itemize Corp. without any obligation of Itemize to you Corp.;
and (f) you are not entitled to any compensation or reimbursement of any kind from

Modifications to Service
Itemize Corp. may modify, terminate, suspend, or otherwise adjust functions or features,

Termination

or resources. Itemize is not responsible for the availability of such external websites
or resources, and does not endorse and is not responsible or liable for any content

Fees
The Service may be available to you with or without charge. You will have the opportunity
to opt-in to any enhanced account and/or fee-based versions of the Service that
may become available.
Itemize’s Proprietary Rights
Itemize Corp. and the Service contain and use intellectual property that is proprietary
and contains trade secrets that are protected by applicable laws. You acknowledge
and agree that Content contained or information presented to you through the Service
is or may be protected by copyrights, trademarks, service marks, patents, or other
proprietary rights.

(ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE
RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE,

demand, including reasonable attorneys' fees, made by any third party due to or

Trademarks
ITEMIZE, the Itemize Logo, Itemize.com and other Itemize logos and product and service
names are or may be trademarks of Itemize Corp. (the "Itemize Marks"). Without Itemize's
prior written permission, and except as solely enabled by any link as provided by
Itemize Corp. you agree not to display or use in any manner the Itemize Marks.
General
The TOS constitutes the entire agreement between you and Itemize Corp. concerning
your use of the Service, superseding any prior agreements between you and Itemize
regarding the Service. If the TOS change materially Itemize Corp. will immediately
post a notification on this website. Your continued use of the Service will constitute
your acceptance of any such changed TOS. The TOS and the relationship between you
and Itemize Corp. shall be governed by the laws of the State of Delaware without
regard to its conflict of law provisions. You and Itemize Corp. agree to submit
to the personal and exclusive arbitration of any disputes arising out of and relating
to your use of the Service under the rules of the American Arbitration Association.
Any such arbitration, to the extent necessary, shall be conducted within the county
of New Castle, Delaware. You covenant not to sue Itemize Corp. in any other forum.
The failure of Itemize Corp. to exercise or enforce any right or provision of the
TOS shall not constitute a waiver of such right or provision. If any provision of
the TOS is found by a court of competent jurisdiction to be invalid, the parties
nevertheless agree that the court should endeavor to give effect to the parties'
intentions as reflected in the provision, and the other provisions of the TOS remain
in full force and effect. The section titles in the TOS are for convenience only
and have no legal or contractual effect.
